Equal Employment Opportunity Policy

Statement

Berger Paints India Limited (“the Company”) is an Equal Opportunity Employer. It is the motto of the Company to place Merit, Integrity and Fitment to job assignment as overriding criteria for employment of personnel. The Company does not practise nor encourages others to practice discrimination on basis of gender, disability, sexuality, religion, region, political affiliation, ancestry and caste relating to employee recruitment and subsequent working environment.

A) Berger Paints India adopted the policy of Equal Opportunities as a tool for addressing inequalities within the workplace and for promoting measures that encourage transparency and equality at work.

B) It entrusts to create a workplace free from discrimination and harassment.

C) It believes that all people will be treated equally or similarly and not be deprived by prejudice or bias irrespective of race, religion, community, gender or any form of disability.

Coverage

All employees of the Company and outsourced personnel work in the company premises.

Salient Features

A) Every employee and all applicants for employment with the Company will be treated equally in all respects. This policy applies in all aspects of employment including, but not limited to:

  • Employment recruitment and hiring
  • Administration of compensation and benefits
  • Job assignments, transfers and promotions in all job classifications
  • On job support in terms of knowledge and necessary infrastructure
  • Training activities, professional development and performance evaluation
  • Supervision, layoffs, use of disciplinary procedures and termination of employment
  • Recreational activities and the use of all Company facilities.

B) Specifically, the Company shall only focus on merit and job suitability and in the process endeavor: To promote Equal Employment Opportunity Policy (EEOP),

  • By embracing Diversity, Equity, and Inclusion culture
  • By protecting the dignity of the vulnerable and marginalized employees, if any.
  • By strongly opposing any culture of bullying and intimidation in workplace
  • By overtly discouraging harassment of any kind in workplace
  • By respecting privacy of employees, especially female employees
  • By being fair, transparent and non-discriminatory in dealings with the employees

C) The Company wishes to align its EEOP with the applicable provisions of Rights of Persons with Disabilities Act, 2016 and consequently adopts and upholds the following:

  • The Company shall ensure that persons with disabilities enjoy the right to equality, life with dignity and respect for his or her integrity equally with others.
  • The Company shall take steps to utilize the capacity of persons with disabilities by providing an appropriate environment.
  • No person with disability shall be discriminated on the ground of disability, unless it is shown that the impugned act or omission is a proportionate means of achieving a legitimate aim.
  • No person shall be deprived of his or her personal liberty only on the ground of disability.

D) Protection from cruelty and inhuman treatment. —

a) The Company shall take measures to protect persons with disabilities from being subjected to torture, cruel, inhuman or degrading treatment.

b) Protection from abuse, violence and exploitation. —

c) The Company shall take measures to protect Employees with disabilities from all forms of abuse, violence, and exploitation and to prevent the same, —

  • Shall take cognizance of incidents of abuse, violence and exploitation and provide redressal mechanisms against such incidents;
  • Shall take steps for avoiding such incidents ;
  • Shall takes steps to rescue, protect and rehabilitate effected victims ; and
  • Create awareness and make available information within the Company .

E) Non-discrimination in employment:-

a) The Company firmly believes in Non-Discrimination relating to employees as mentioned under ‘Statement’.

b) The Company establishment shall provide reasonable infrastructure and appropriate barrier free and conducive environment to employees with disability.

c) No promotion shall be denied to a person merely on the ground of disability.

d) The Company establishment shall not dispense with or reduce in rank of an employee who acquires a disability during his or her service: Provided that, if an employee after acquiring disability is not suitable for the post he was holding, shall be shifted to some other post with the same pay scale and service benefits.

Responsibility

A) The ultimate responsibility for Company-wide compliance with this policy rests with Personnel & Administration Department, Plant Heads and Corporate HR Department.

B) In all the above matters guidelines enunciated by Grievance redressal Mechanism for employees shall be followed. Any complaints raised on Equal opportunity matters, which is proved to be untrue and is solely designed to malign/ damage the reputation of any individual in the company shall be dealt with strictly by management with adverse consequence bearing on the Complainant.

General

A) The Company and/or Management reserves the right to modify or withdraw the Policy either in part or whole without prior notice.

B) This policy shall supersede all existing instructions, procedures, circulars and practices pertaining to this policy, if any, prior to the date of issue of this policy.

C) This policy does not constitute a contractual term or a contractual promise.
